1. Acceptance of Terms
Welcome to HabitBlock ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of the HabitBlock productivity and accountability application (the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service.
2. Description of Service
HabitBlock is a digital productivity and accountability application that helps users create, monitor, and analyze their daily habits and objectives so that they are productive. Our Service includes features for objective setting, progress tracking, analytics, reflection tools, and premium functionality through subscription plans. We may also provide optional email reminders, weekly reports, and security alerts, which you can configure in your account preference.
3. User Accounts
3.1 Account Creation
To use certain features of our Service, you must create an account by providing:
- A valid email address
- A secure password
- Accurate and complete registration information
3.2 Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your account information remains accurate and up-to-date
3.3 Age Requirements
You must be at least 13 years old to create an account. Users under 18 must have parental or guardian consent to use the Service. If you are located in the European Economic Area (EEA), you must be at least 16 years old to use the Service.
4. Subscription Plans and Billing
4.1 Subscription Tiers
We offer the following subscription plans:
- Habit Pro: Enhanced features with up to 12 objectives and analytics
- Habit Plus: Full access to all premium features
Additional plans may be introduced or plans may be discontinued at our discretion.
4.2 Billing Terms
- Subscriptions are billed in advance on a recurring basis
- Billing cycles is annually
- Payments are processed securely through Stripe
- All fees are non-refundable except as required by law
- Prices may change with 30 days' notice to existing subscribers
- If payment cannot be processed, your subscription will be suspended until payment is successfully completed.
4.3 Cancellation and Refunds
- You may cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of the current billing period. NOTE: Billing period is annual
- You will retain access to paid features until the subscription expires
- Refunds are not provided for partial billing periods
- We may offer prorated refunds at our discretion for exceptional circumstances
- Upon cancellation, data associated with paid features may be restricted or deleted. Please export your data before cancellation if you wish to retain it.
5. Acceptable Use Policy
5.1 Permitted Uses
You may use the Service only for lawful purposes and in accordance with these Terms.
5.2 Prohibited Conduct
You agree not to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others, including intellectual property rights
- Attempt to gain unauthorized access to the Service or other users' accounts
- Use the Service to transmit malware, viruses, or harmful code
- Engage in any form of harassment, abuse, or harmful behavior
- Attempt to reverse engineer, decompile, or disassemble the Service
- Use automated tools to access the Service without permission
- Share your account credentials with others
- Use the Service for commercial purposes without authorization
We reserve the right to suspend or terminate accounts engaged in excessive automated activity that interferes with system performance or other users’ access.
6. User Content and Data
6.1 Your Content
You retain ownership of all content you create or upload to the Service, including objectives, reflections, and personal data. By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service to you.
6.2 Data Backup and Export
We provide tools for you to export your data. You are responsible for maintaining your own backups of important information. We are not liable for data loss, though we implement reasonable backup and recovery procedures. We offer both “soft delete” (temporary) and “hard delete” (permanent) options in your user preferences. Permanently deleted data cannot be restored.
6.3 Content Standards
While your data is private, any content shared or made public must comply with our community standards and not contain illegal, harmful, or offensive material.
7. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. 8. Intellectual Property
8.1 Our Rights
The Service, including its design, functionality, text, graphics, logos, and software, is owned by us and protected by copyright, trademark, and other intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
8.3 Feedback
Any feedback, suggestions, or ideas you provide to us become our property and may be used to improve the Service without compensation to you.
9. Service Availability
9.1 Availability
We strive to provide reliable service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or technical issues. We will use commercially reasonable efforts to notify you of planned downtime that may significantly impact usage.
9.2 Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will provide reasonable advance notice for significant changes when possible.
10. Termination
10.1 Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature in your settings.
10.2 Termination by Us
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. We will provide notice when reasonably possible.
10.3 Effects of Termination
Upon termination, your access to the Service will cease, and your data may be deleted after a reasonable period. You remain responsible for any outstanding fees.
11. Disclaimers and Limitation of Liability
11.1 Service Warranty
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
13. Dispute Resolution

These Terms are governed by the laws of United Kingdom, without regard to conflict of law principles.
13.2 Dispute Resolution Process
Before filing any legal action, you agree to first attempt to resolve disputes through direct negotiation with us. If unsuccessful, disputes may be resolved through binding arbitration or in the appropriate courts of United Kingdom.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
14.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
14.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
14.4 Assignment
You may not assign your rights under these Terms without our written consent. We may assign our rights without restriction.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
